SIVANANDA YOGA VEDANTA NATARAJA SOCIETY, having its registered office at PSP Pocket, Sector \u2013 6 , Swami Sivananda Marg, Dwarka, New Delhi, India (\u201cCompany\u201d or \u201cwe\u201d or \u201cus\u201d), is the owner of the website domain at yoga.in or online.yoga.in and explore.yoga.in respectively (referred as \u201cPlatform\u201d).<\/p>\n

Any Service availed by Users of the Platform (as defined in the Terms of Service) (hereinafter\u00a0referred to as \u201cyou\u201d, \u201cyour\u201d or \u201cUser\u201d) through the Platform is conditioned upon your acceptance of the terms and conditions contained in Terms of Service, as available on Platform and this privacy\u00a0policy (\u201cPrivacy Policy\u201d).<\/p>\n

THIS PRIVACY POLICY HAS BEEN DRAFTED AND PUBLISHED IN ACCORDANCE WITH THE INFORMATION TECHNOLOGY ACT 2000, THE INFORMATION TECHNOLOGY\u00a0(AMENDMENT) ACT 2008, AND THE INFORMATION TECHNOLOGY (REASONABLE SECURITY PRACTICES AND PROCEDURES AND SENSITIVE PERSONAL DATA OR\u00a0INFORMATION) RULES 2011. 1. Introduction and applicability of the Privacy Policy<\/span><\/p>\n

2.1 Please be advised that any Information (as defined herein below) procured by us, shall be: a. processed fairly and lawfully for rendering the Services (as defined in Terms of\u00a0Service);
\nb. obtained only for specified and lawful purposes, and not be used in any manner which is against the law or policy in force in India (\u201cApplicable Law\u201d);
\nc. adequate, relevant and not excessive in relation to the purpose for which it is required;
\nd. able to be reviewed by the User, from time to time and updated-if need arises; and
\ne. not kept longer than for the time which it is required or the purpose for which it is required or as required by the Applicable Law.<\/p>\n

3.1 Please note that by providing the Information (as enumerated upon herein below) or by consenting to the provision of the Information by your authorised Representative, you\u00a0provide your consent and authorise us to collect, use or disclose Information for the\u00a0Legitimate Purposes (as defined below) and as stated in this Privacy Policy, the Terms of\u00a0Service and as permitted or required by Applicable Law. Moreover, you understand and\u00a0hereby consent that this Information may be transferred to any third-party user for the\u00a0purpose of providing Services through the Platform or to any third-party providers for\u00a0rendering Services (as defined in the Terms of Service), any jointly developed or marketed\u00a0services, payment processing, order fulfilment, customer services, data analysis, information\u00a0technology services and such other services which enable us to provide Services through the Platform.<\/p>\n

3.2 This Privacy Policy shall be enforceable against you in the same manner as any other written\u00a0agreement. By visiting or accessing the Platform and voluntarily providing us with\u00a0Information (including Personal Data), you are consenting to our use of the Information, in\u00a0accordance with this Privacy Policy. If you do not agree with this Privacy Policy, you may\u00a0refuse or withdraw your consent any time, or alternatively choose to not provide us with any\u00a0Personal Data or Sensitive Personal Information. Under such circumstance, your access to the Services we provide may be limited or we may be unable to render Services.<\/p>\n

4. Types of information collected by us:<\/span><\/p>\n

4.1 \u201cPersonal Data\u201d means and includes any information that relates to a natural person through\u00a0which an individual is identified, such as the name, date of birth, educational information and\u00a0related data, contact details, email address, gender, age, insurance data or any other\u00a0relevant material provided by a User, including but not limited to, information gathered\u00a0through availing Services. User, as part of onboarding process, may be required to provide\u00a0name, mobile number of two individuals, family doctor, speciality doctor (\u201cContact Personnel\u201d). User represents and warrants that it shall obtain prior consent of Contact\u00a0Personnel before sharing any personal data of Contact Personnel with the Company.<\/p>\n

4.2 \u201cSensitive Personal Information\u201d shall mean personal information, which consists of\u00a0information relating to any to the following of an individual:<\/p>\n

i. physical, physiological and mental health condition;
\nii. sexual orientation;
\niii. insurance data;
\niv. important dates and events;
\nv. personal interest;
\nvi. medical records and history;
\nvii. banking and finance related documents (excluding passwords, pins etc.);
\nviii. legal documents, agreements;
\nix. vehicle registration documents;
\nx. health data.<\/p>\n

4.3 \u201cTechnical Information\u201d means and includes any information gathered through various\u00a0technologies that may employ cookies, web beacons, or similar technologies to\u00a0automatically record certain information from your device through which you use the\u00a0Platform. This technical information may include your Internet Protocol (IP) address, device\u00a0or browser type, Internet Service Provider (ISP), referring or exit pages, clickstream data,\u00a0operating system, hardware model, operating system version, unique device identifiers, and\u00a0mobile network. This data includes usage and log information and user statistics.<\/p>\n

4.4 \u201cLocational Information\u201d shall mean and include the geo-information obtained through\u00a0GPS or other means, such as the geographical location of the User and sensor data from\u00a0the device on which you access the Services.<\/p>\n

4.5 \u201cNon-Personal Information\u201d\u00a0a. \u201cInformation through use of our Service\u201d means and includes information which is shared\u00a0with us to avail our Services.<\/p>\n

b. \u201cNon-Personal Information\u201d means and includes any information that does not reveal your specific identity, such as, browser information, information collected through Cookies\u00a0(as defined below), pixel tags and other technologies, demographic information, crash\u00a0reports, system activity, device state information etc. As is true with most websites and\u00a0mobile applications, Company gathers some information automatically when you visit the\u00a0Platform. When you use the Platform, we may collect certain information about your\u00a0computer or mobile to facilitate, evaluate and verify your use of the Platform. For example,\u00a0we may store environmental variables, such as browser type, operating system, speed of the central processing unit (CPU), referring or exit web pages, click patterns and the internet protocol (IP) address of your computer. This information is generally collected in aggregate\u00a0form, without identifying any user individually.<\/p>\n

(The Personal Data, Sensitive Personal Information, Technical Information, Locational Information, and Non-Personal Information are collectively referred to as \u201cInformation).<\/p>\n

5. Purpose of Collection and Usage of this Information:<\/span><\/p>\n

5.1 The Information collected by us shall be used for availing our Services and utilised for other functions including but not limited to:<\/p>\n

a. to render Services (as defined in the Terms of Service);
\nb. for maintaining the Platform;
\nc. to evaluate the quality and competence of our personnel;
\nd. to resolve any complaints, you may have and ensure that you receive the highest quality of Services;

\nf. allowing you to participate in interactive features of our Platform when you choose to do so;

5.2 Business or Research Purposes: The Information saved and except Personal Data, is used for business or research purposes, including improving and customising the Platform for\u00a0ease of use and the products and services offered by us. We may archive this information\u00a0to use it for future communications for providing updates and\/or surveys.<\/p>\n

5.3 Aggregating Information \/ Anonymised data: We may aggregate Information and analyse it in a manner to further accentuate the level of services that we offer to our customers. This\u00a0Information includes average number of Users of the Platform, the average clicks of the\u00a0services\/, the features used, the response rate, etc. and other such statistics regarding\u00a0groups or individuals. In doing so, we shall not be making disclosures of any Personal Data\u00a0as defined above.\u00a0(Collectively referred to as \u201cLegitimate Purposes\u201d)<\/p>\n

6. Disclosure and Sharing of Information:<\/span><\/p>\n

6.1 We do not rent, sell or disclose or share any Information that we collect from you, with third\u00a0parties, save and except in order to provide you with the Services or for the Legitimate\u00a0Purposes as specified above. Any such disclosure, if made, shall be in accordance to this\u00a0Privacy Policy and as per the procedure prescribed by law and in compliance with our legal\u00a0obligations. \nvi. to allow us to pursue available remedies or limit the damages that we may\u00a0sustain;
\nvii. to protect against legal liability;
\nviii. to protect the personal safety of Users of the Platform;

c. Merger or Acquisition: We may share Information upon merger or acquisition of\u00a0Company with another company. We shall transmit and transfer the Information upon\u00a0acquisition or merger of Company with another company;<\/p>\n

d. With our service providers: We may share Information with other service providers on a need-to-know basis, subject to obligations of confidentiality for provision of Services. We\u00a0hereby clarify that the Company works with institutions, vendors, partners, advertisers, and\u00a0other service providers, including (but not limited) to those who provide products or services\u00a0such as contact Information verification, website hosting, data analysis, providing infrastructure, information technology services, auditing services and other similar services, in different industries and categories of business by virtue of lawful contracts instituted\u00a0between such third parties and Company to improve our product and services. Accordingly,\u00a0we may share your Information with such service provider in order to provide you with\u00a0Services;<\/p>\n

e. Employees \/Agents of Company: We follow a strict confidentiality policy with regard to disclosure of confidential information to our employees or other personnel. There may be situations, where we may disclose the confidential information only to those of our\u00a0employees and other personnel on a need-to-know basis. Any breach of confidential information by the employees, personnel within the Company is dealt with stringently by us.<\/p>\n

6.2 Except for the Information disclosed pursuant to sub-clause (a), (b), (c), (d) and (e) of Clause<\/p>\n

6.1 above, Company may share Information, if you authorise us to do so.<\/p>\n

7. Transfer of Information<\/span><\/p>\n

7.1 Your information may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the data protection\u00a0laws may differ from those from your jurisdiction.<\/p>\n

If you want to withdraw your consent or raise any objection to the use of your information for receiving any direct marketing information to which you previously opted-in, you can do so by contacting our customer support at above mentioned addresses. If you withdraw your consent or object to the use of your information, our use of the information provided by you\u00a0before your withdrawal\/objection shall still be lawful.<\/p>\n

9. Children\u2019s Privacy<\/span><\/p>\n

Our Platform and Services are not meant for use by children and we knowingly do not collect Information of\/from children. If it comes to our notice that we have collected Information from\/of children, we shall take steps to remove such Information from our servers. If you\u00a0believe that we might have any Information that may have been collected from a child or has\u00a0been provided by a child, please write to us at the email id provided in Clause 3.3.<\/p>\n

10. Control the collection or use of the Information<\/span><\/p>\n

If you have any reservations, constraints or apprehensions regarding the access to, collection, storage, or any other use of the Information which you have provided to us, you\u00a0may withdraw your consent in the manner as set out in Clause 3.3 above.<\/p>\n

11. Retention of Information<\/span><\/p>\n

All Information provided by you, save and except upon withdrawal or termination, shall be\u00a0retained in locations outside the direct control of Company (for instance, on servers or\u00a0databases co-locates with hosting providers). We will delete Information based on a request\u00a0received from you within a reasonable period and latest within thirty (30) days of receiving a\u00a0deletion request. However, we may retain such portion of Information and for such periods\u00a0as may be required under Applicable Law. Notwithstanding anything contained herein,<\/p>\n

Company may retain data after account deletion for reasons including but limited to the\u00a0following purposes: If there is an unresolved issue relating to your account, or an unresolved\u00a0claim or dispute; If we are required to by Applicable Law, and\/or in aggregated and\/or\u00a0anonymised form, or Company may also retain certain information if necessary, for its\u00a0legitimate business interests, such as fraud prevention and enhancing Users’ safety and security.<\/p>\n

12. Cookies and other Tracking Technologies<\/span><\/p>\n

12.1 Our Platform may utilize \u201ccookies\u201d and other Technical Information. \u201cCookies\u201d are a small text file consisting of alphanumeric numbers used to collect the Information about Platform activity. The Technical Information helps us analyse web traffic and helps you by customising the Platform to your preferences. Cookies in no way gives us access to your computer or\u00a0mobile device. In relation to Cookies, you can deny access to the installation of the Cookies\u00a0by modifying the settings on your web browser, however, this may prevent you from taking\u00a0full advantage of the Platform.<\/p>\n

12.2 Our use of Cookies and Technical Information allows us to improve Platform and your\u00a0experience of Platform and Services. We may also analyse Technical Information that does not contain Personal Data or Sensitive Personal Information for trends and statistics.<\/p>\n

13. Third Party Services<\/span><\/p>\n

We may use your Information to send you promotional Information about third parties which,\u00a0we think you may find interesting, if you tell us that you wish this to happen. We shall not be\u00a0responsible for any disclosure of Information due to unauthorised third-party access or other\u00a0acts of third parties or acts or omissions beyond our reasonable control and you agree that you will not hold us responsible for any breach of security unless such breach has been\u00a0caused as a direct result of our negligence or wilful default.<\/p>\n

Once you leave the Platform, we are not liable for any use\/ storage \/ processing \/ collection\u00a0of your information obtained by any third-party websites or payment facilitators or provided\u00a0by you to these third-parties or payment facilitators. Such entities and their respective\u00a0websites\/platforms may be governed by their own \u201cPrivacy Policy\u201d and \u201cTerms of Service\u201d,\u00a0which are beyond our control.<\/p>\n

14. Data Security<\/span><\/p>\n

You agree and accept that your Information may be stored in third-party cloud service\u00a0infrastructure providers. While all reasonable attempts have been taken from our end to\u00a0ensure the safe and secure storage of your data, we shall not be liable for any data breach\u00a0on the part of the third-party cloud service infrastructure provider that was beyond our\u00a0control. In addition to the security measures put in place by the third-party cloud service\u00a0infrastructure provider for safe and secure storage of your Information, we use certain\u00a0physical, managerial, technical or operational safeguards as per industry standards and\u00a0established best practices to protect the Information we collect. We use reasonable security practices and procedures and use secure servers as mandated under Applicable Laws for\u00a0the protection of your Information. We review our Information collection, storage, and\u00a0processing practices, including physical security measures to guard against unauthorised\u00a0access to systems. However, as effective as these measures are, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that\u00a0the Information you supply will not be intercepted while being transmitted to us over the\u00a0internet. You accept the inherent security implications of data transmission over the internet\u00a0and the internet cannot always be guaranteed as completely secure. 15. Changes and updates to Policy<\/span><\/p>\n

We shall endeavour to review, revise, update,\u00a0modify, amend or correct the Privacy Policy on a regular and routine basis, especially\u00a0whenever a significant update is made to the technology employed by us. In\u00a0the event you continue to use the Platform and our services after any update in the Privacy\u00a0Policy, your use of the Platform shall be subject to such updated privacy policy. Your\u00a0continued usage of Services, post any amendment would deem to mean that you accept\u00a0and understand the revised Privacy Policy. ALL UNSOLICITED INFORMATION SHALL BE\u00a0DEEMED TO BE NON-CONFIDENTIAL AND WE SHALL BE FREE TO USE AND\/ OR\u00a0DISCLOSE SUCH UNSOLICITED INFORMATION WITHOUT ANY LIMITATIONS. THE\u00a0RIGHTS AND REMEDIES AVAILABLE UNDER THIS POLICY MAY BE EXERCISED AS\u00a0OFTEN AS NECESSARY AND ARE CUMULATIVE AND NOT EXCLUSIVE OF RIGHTS\u00a0OR REMEDIES PROVIDED BY LAW.
